Reviewing the CY 2023 Medicare Outpatient Proposed Rule and New Rural Emergency Hospital Designation


The Centers for Medicare & Medicaid Services (CMS) recently released the CY 2023 Outpatient Prospective Payment System (OPPS) and Ambulatory Surgical Center (ASC) Payment System Proposed Rule. The rule proposes several changes to outpatient Medicare payment policy and quality programs, including addressing 340B discount drug payments and adjusting payments for domestically-produced N95s.

Additionally, CMS recently released a proposed rule implementing the requirements and conditions of participation for Rural Emergency Hospitals (REHs). This new Medicare provider designation will allow critical access hospitals and certain small rural hospitals to convert to a REH and furnish emergency department services, observation care, and other certain outpatient services, beginning on Jan. 1, 2023.
